But if the unbelieving depart, let him depart. A brother or a sister is not under bondage in such cases: but God has called us to peace.

Ambrosiaster

AD 400
A marriage contracted without devotion to God is not binding, and for that reason it is not a sin if it is abandoned because of God. But the unbelieving partner sins both against God and against the marriage, because he or she is unwilling to live in a marriage relationship dedicated to God. It is not right to go to court over this because the one who leaves the marriage is doing so out of hatred for God, and for this reason he or she is not to be considered worthy of such attention. A Christian husband may leave his wife without any blame, even if they are lawfully married, if she refuses to live with him because he is a Christian.

But if the unbelieving depart, let him depart. If the unbeliever seek for a dissolution of the marriage, or will not live with his partner without doing injury to God, by endeavouring to draw her way to unbelief or to some wickedness, or by uttering blasphemy against God, or Christ, or the faith, then, as Sanchez lays down from the common consent of the Doctors of the Church (vol. ii. disp74), he by so acting is rightly regarded to wish for a separation; then let the unbeliever depart from the unbelieving, because it is better, says S. Chrysostom, to be divorced from one"s husband than from God. Observe that the Apostle in this case allows a separation, not only a toro but also a vinculo; and therefore the believer may contract another marriage, this being a concession made by Christ in favour of the faith; otherwise a Christian man or woman would be subject to slavery. For it is a grievous slavery to be bound in matrimony to an unbeliever, so as not to be able to marry another, and t...

AD 407
If an unbeliever wants his partner to join him in sacrificing to idols, it is better for the marriage to be annulled, so that there may be no breach in godliness.

John Chrysostom

AD 407
Yet if the unbelieving departs, let him depart, for in this case the matter is no longer fornication. But what is the meaning of, if the unbelieving departs? For instance, if he bid you sacrifice and take part in his ungodliness on account of your marriage, or else part company; it were better the marriage were annulled, and no breach made in godliness. Wherefore he adds, A brother is not under bondage, nor yet a sister, in such cases. If day by day he buffet you and keep up combats on this account, it is better to separate. For this is what he glances at, saying, But God has called us in peace. For it is the other party who furnished the ground of separation, even as he did who committed uncleanness.
